REPORTS OF BIRTH ABROAD

U.S. citizen parents of a child born in Azerbaijan can come to the Consular Section to determine whether the child is eligible for U.S. Citizenship.  A Report of Birth Abroad will serve as proof of the child’s U.S. citizenship.

Citizenship transmission requirements vary depending on whether one or both parents were U.S. citizens; whether the child was born in or out of wedlock; and the child’s date of birth.

A child born to two American citizen parents abroad automatically acquires U.S. citizenship at birth if one of the parents has resided in the U.S. or its outlying possessions before the birth of the child.

In general, a child born on or after November 14, 1986 to one American citizen parent may acquire U.S. citizenship, if the American parent meets the transmission requirement of having resided in the U.S. for at least 5 years prior to the child’s birth, two of which were after attaining the age of 14.

To register the birth of your child, both parents and the child must appear in person before the Consular Officer and must:

• Complete the application for Consular Report of Birth Abroad
• Submit the Child’s Local Birth Certificate
• Submit the Child’s Medical Birth Certificate (issued by the hospital, where the birth took place)
• Provide the Parents’ Passports
• Provide the Parents’ Marriage Certificate (if applicable)
• Provide divorce decree of either parent (if applicable)
• Submit affidavits of parent(s)’ residence and physical presence in the United States
• Submit supporting documents proving parent’s presence in the U.S.  If only one parent is an American citizen provide proof of that parent’s 5 year presence in the U.S. (high school, college diplomas, rental contracts, tax returns, etc.)

When you apply for a Consular Report of Birth Abroad, you may also apply for a passport and social security number for your child. For a passport, in addition to the above listed requirements, you must also complete form DS-11 Application for Passport, provide two passport photos, and pay the fee of $85.00. For a social security number, in addition to the above listed requirements, you must also complete an Application for Social Security Card
